The SC Pollution Control Act (PCA) was enacted in 1972, two years before the federal Clean Water Act. While many requirements in this statute are covered in the CWA, the SC Pollution Control Act has additional requirements not set forth in its federal counterpart (such as requiring a permit for construction of a wastewater treatment plant). The SC Department of Health and Environmental Control (SCDHEC) is the primary regulatory agency responsible for administering the requirements of both the PCA and the CWA, although the Department of Natural Resources (DNR) also deals with water quality issues as related to the protection of wildlife. DHEC sets water quality standards, as required by the Clean Water Act, and issues NPDES permits.
